Report: Judge won't dismiss Chrysler dealer termination suit stemming from '09 bankruptcy
Filed under: Car Buying, Government/Legal, Chrysler, Earnings/Financials
A Federal judge will allow some 75 Chrysler dealers to proceed with a lawsuit against the U.S. Treasury Department, according to Automotive News. The dealers insist that the government violated the Fifth Amendment in administrating the Chrysler bankruptcy when it terminated their dealership franchises.
The lawsuit asks for some $200 million in damages, according to the report, but does not name the bankrupt automaker. Chrysler shed 789 dealers as part of its 2009 bankruptcy, a process that has led to no shortage of lawsuits and angry former stakeholders.
Whether the ranks of jilted dealers participating in the suit will swell remains to be seen. AN quotes the dealers' attorney, Leonard Bellavia of Mineola, N.Y., as saying, "We received a very important decision today. After this decision, I expect those dealers sitting on the sidelines to join the case."
The lawsuit, filed last February, will now move to discovery, according to Bellavia, who told AN he plans to depose Treasury officials who worked on the auto task force headed by "Car Czar" Stephen L. Rattner.

T.I. Signs Trae Tha Truth To Grand Hustle
'We're gonna work alongside each other for a common goal and release this Trae tha Truth project,' T.I. tells 'RapFix Live.'
By Rob Markman

T.I.'s hustle just got a little more grand. Not only is the King of the South gearing up to release his eighth studio album, Trouble Man, Tip is also expanding his Grand Hustle roster, adding new artists at seemingly every turn. His latest addition: Houston street king Trae tha Truth.
Trae and Tip announced the joint venture deal between Grand Hustle and the Houston MC's ABN label Wednesday (February 29) on "RapFix Live."
"We're gonna work alongside each other for a common goal and release this Trae tha Truth project," T.I. said of the deal, which was arrived at the old-fashioned way. "When cats [who are] cut from a certain cloth give their word and shake their hand, that's what makes it a done deal — the ink is just a formality."
The two haven't yet figured out how Trae's upcoming ABN projects will be distributed, however. T.I. is currently signed to Atlantic through Grand Hustle, but that doesn't necessarily mean that Trae's project will travel through the same channels. But Trae doesn't seem overly concerned about the particulars. "Me and Tip are similar in a lot of ways. We both understand what it is," Trae said.
"The thing that kinda made me way more comfortable is he reached out more on a partner note to where it wasn't about money, it wasn't about none of that. It was about, 'Look, we can team up or even if you doin' your own thing, I'm just supporting what you got goin', I want to see you make it.' "
Without the help of a major label, Trae has already carved out his lane in the streets. While he isn't the most popular MC, it's hard to find an artist in the game today who is more respected. His last album, Street King, featured not only underground rappers like Messy Marv and Yo Gotti, but also boasted contributions from the likes of Lil Wayne, Rick Ross, Big Boi and Wiz Khalifa.
"Grand Hustle is an established brand, ABN is already an established brand, it's about seeing what we can do to parlay what we've already done for ourselves to make it benefit the other and it's a two-way street," T.I. explained.
What do you think of Trae tha Truth and T.I.'s new deal? Tell us in the comments!

Beyonce And Jay-Z's Blue Ivy Trademark: An Expert Explains
Couple likely 'trying to protect what they rightfully own or created,' family law expert tells MTV News.
By John Mitchell

<P><a href="/music/artist/knowles_beyonce/artist.jhtml">Beyoncé</a> and <a href="/music/artist/jay_z/artist.jhtml">Jay-Z</a> have filed an application with the U.S. Patent and Trademark Office to protect their month-old baby's name and reserve it for future use, MTV News has confirmed. The superstar couple reportedly sought the trademark to stop the use of Blue Ivy's name by others. </p><div class="player-placeholder right" id="vid:725377.id:1676907" width="240" height="211"></div><p> It's a smart move, according to family law attorney and author <a href="http://www.vikkiziegler.com/" target="_blank">Vikki Ziegler</a>. "[Seeking the trademark] forestalls competitors from using the child's name and or third parties from attempting to sell the baby's name back to the couple," Ziegler told MTV News. "They are likely trying to protect what they rightfully own or created, shall we say, by trademarking Blue Ivy's name." The application to trademark Blue Ivy Carter's name, filed by BGK Trademark Holdings (Beyoncé's company) is currently pending but will likely be approved because, as the <a href="http://www.washingtonpost.com/blogs/reliable-source/post/blue-ivy-the-trademark-feds-move-fast-on-rights-to-beyonce-and-jay-zs-babys-name/2012/02/03/gIQAOTDGnQ_blog.html" target="_blank"><i>Washington Post</i></a> reports, parents are legally authorized to trademark the names of their minor children. "In essence, it's a trademark for a brand, and this brand is expected to be one hot commodity — just look at Blue Ivy's parents," Ziegler said. "Anyone else that tried to use the name after the trademark was approved could be sued and held liable for damages." </p><div class="player-placeholder right" id="vid:724613.id:1676907" width="240" height="211"></div><p> While the Patent Office looks fondly on attempts to trademark the name of one's own child, attempts to do the same with the names of other people's kids are another story, as two designers learned when they sought — just days after Blue Ivy's birth — to trademark the baby's name for their own use. Applications from fashion designer Joseph Mbeh to patent "Blue Ivy Carter NYC" and by an unnamed designer to trademark "Blue Ivy Carter Glory IV" for a fragrance line were denied by the Patent Office, which noted in its decision that the name belonged to a "very famous infant" and consumers would wrongly assume that any products bearing the name had been approved by Beyoncé and Jay-Z. Ziegler noted that the trademark would "protect against others using the child's name as a brand of merchandise in the same marketplace," so it will not impact the "Blue Ivy" trademark held by a clothing boutique in Sturgeon Bay, Wisconsin. The store filed to trademark <i>its</i> name on January 19, 2011, a year before Queen B and Jay made the name famous. They received approval on August 23 — five days before <a href="/news/articles/1669849/beyonce-pregnant-vmas.jhtml">Beyoncé announced her pregnancy</a> at the MTV Video Music Awards. <i>What do you think about Beyoncé and Jay-Z trademarking Blue Ivy's name? Let us know in the comments!</i></p>

Oscar 2012 Best Presenters: Robert Downey Jr., Bridesmaids, More
Co-stars Will Ferrell and Zach Galifianakis make a hilariously musical entrance, while Sandra Bullock shows off some impressive German.
By Terri Schwartz
Robert Downey Jr. and Gwyneth Paltrow present at the 84th annual Academy Awards

There are typically two kinds of presenters at the Oscars: the earnest and the hilarious. But every year, a handful of actors manage to capture the goal of either category in a way that makes the moment unforgettable.
On Sunday night, the Kodak Theatre saw plenty of earnest presenters. Natalie Portman, Colin Firth and Morgan Freeman reminded viewers why we love the Oscars.
But it was the presenters with the funny bits who really stole the show. Whether comparing short films to male genitalia or tossing cymbals onstage when they should have been reading out the name of an award winner, we couldn't stop chuckling. Here, the MTV Movies team handpicks the five most memorable presenters of the 2012 Oscars.
Robert Downey Jr., Documentarian
Trying to stay ahead of the curve, Robert Downey Jr. and a camera crew joined Gwyneth Paltrow onstage to present the Best Documentary award in an attempt to popularize his new art form, "live documentary." Of course, as Paltrow pointed out, that's called the news, but we couldn't get enough of their Tony Stark/ Pepper Potts-style banter several months before "The Avengers" hits theaters. And we like that Downey joked that he turned down the role in "The Descendants" with George Clooney looking on from the crowd.
Emma Stone Is Super Good
Yes, Emma Stone is charming, but we were still surprised at how well she pulled off the task of co-presenting Best Visual Effects alongside Ben Stiller. First-time Oscar presenter Stone acted out her skit flawlessly and even managed to poke fun at Stiller's previous presenting stunts in the process. But it was her asking "Superbad" co-star Jonah Hill to come onstage and dance with her — and his subsequent refusal — that made this one of the funniest moments of the night.
Sandra Bullock Is "Extremely" Bilingual
Did you know Sandra Bullock was bilingual? It certainly made her presenting the Oscar for Best Foreign Film all the more fitting. And although the actress said she was going to present the award in Mandarin, Bullock actually announced the award in German. For those who wondered about the Academy's motivation for having the "Extremely Loud and Incredibly Close" star present in a different language, it turns out it was because the Academy Awards "are an international show and because there are over 1.2 billion people in China." So why not?
Will Ferrell and Zach Galifianakis Make Music
Leave it to the stars of the upcoming political comedy "The Campaign," Will Ferrell and Zach Galifianakis, to make one of the funniest and most dramatic appearances of the night. Dressed in all-white tuxedos, the duo emerged from the orchestra pit smashing cymbals together. Because how else do you expect comedians to present the award for Best Original Song? Fortunately, winner Bret McKenzie also had a good sense of humor in his acceptance speech for "The Muppets" song "Man or Muppet."
"Bridesmaids" Stars Toast Scorsese Again
Who else but the cast of "Bridesmaids" could make presenting the three short-film categories one of the most hilarious of the night? Sure, Kristen Wiig and Maya Rudolph's whole opening spiel was one big penis joke, but can you expect any less when Melissa McCarthy earned her Oscar nomination for a part that featured her comically defecating in a sink? We're still trying to figure out what the rules of Rose Byrne and McCarthy's Martin Scorsese drinking game are, but we'll let you know when we do.

Them Crooked Vultures make their debut with a post-Lollapalooza set.
By James Montgomery
Photo: Jewel Samad/AFP/Getty Images
<P><P>Officially, <a href="/news/articles/1617945/janes-addiction-killers-turn-up-heat-on-lollapaloozas-last-day.jhtml">Lollapalooza ended Sunday night</a> in Chicago's Grant Park, with dueling sets from <a href="/music/artist/killers_the/artist.jhtml">the Killers</a> and <a href="/music/artist/janes_addiction/artist.jhtml">Jane's Addiction</a>. Unofficially, it ended <i>very</i> early Monday morning, across town at venerable rock club the Metro, with a surprise show by Them Crooked Vultures. To the unfamiliar, the Vultures might seem like an odd choice to close out Lolla weekend ... until you realize that they're made up of <a href="/music/artist/foo_fighters/artist.jhtml">Foo Fighters</a> frontman/ former Nirvana drummer Dave Grohl, <a href="/music/artist/queens_stone_age/artist.jhtml">Queens of the Stone Age</a> mastermind Josh Homme and <a href="/music/artist/led_zeppelin/artist.jhtml">Led Zeppelin</a> legend John Paul Jones. And their gig at the Metro was their world premiere. According to <a href="http://blogs.suntimes.com/derogatis/2009/08/them_crooked_vultures_at_metro.html" target="_blank">some reports</a>, the Vultures actually turned <i>down</i> Lollapalooza founder Perry Farrell's request to replace the Beastie Boys as headliners at the festival, opting to debut in front of some 1,100 super-psyched fans at the Metro, rather than 75,000 in Grant Park (tickets for the gig were announced via Foo Fighter/ QOTSA fan clubs). Meaning that, in a lot of ways, this was the most sought-after ticket in town. Taking the stage just after midnight, the Vultures — Grohl on drums (of course), Homme on guitar and vocals, Jones on bass and keys and frequent QOTSA contributor Alain Johannes on guitar — ripped through 12 songs in 80 minutes, all taken from their upcoming debut, which may or may not be called <i>Never Deserved the Future,</i> and may or may not be hitting stores on October 23 (early "promo" videos touting both those facts were revealed over the weekend to be hoaxes perpetrated by QOTSA fans). The songs, with appropriately Homme-ian titles like "Scumbag Blues," "Mind Eraser (No Chaser)," "Caligulove" and "Interlude w/Ludes," sounded pretty much how you'd expect, given the band's pedigree. They rocked, hard — <a href="http://leisureblogs.chicagotribune.com/turn_it_up/2009/08/concert-review-them-crooked-vultures-at-metro.html" target="_blank"><i>Chicago Tribune</i></a> critic Greg Kot described them as "fresh, invigorating and just plain nasty" — delving off into psychedelic, reverb-filled excursions and exploring proggy territory, "both of the old-school Yes variety, and the more modern Tool flavor," according to the <i>Chicago Sun-Times'</i> Jim DeRogatis. It's not known if Monday's Metro performance was a one-off event for the Vultures — there have been whispers of a full-blown tour, but a spokesperson for Homme had not responded to MTV News' request for comment at press time. Nor was it clear whether or not they'll have an album out in October. Early Monday, a <a href="http://twitter.com/crookedvultures" target="_blank">Crooked Vultures Twitter account</a>, which had previously posted links to the band's <a href="http://www.themcrookedvultures.com/" target="_blank">official-looking Web site</a> and the Metro's online ticketing site — posted a link to what appears to be the group's first bit of official merchandise: a <i>Deserve the Future</i> T-shirt. Cost: $30.</p></p>

Adam Lambert's 'Whole Lotta Love': The Story Behind The Cover
Glam rocker tackled the legendary 1970 Led Zeppelin song for 'American Idol' rock night.
By Gil Kaufman

<P>Imagine a freight train speeding toward you at midnight. Or a rockslide barreling down a hill as you try to outrace it. That's the feeling of the ominous, chugging Jimmy Page riff that kicks off <MTVNLINK type="url" id="http://www.mtv.com/music/artist/led_zeppelin/artist.jhtml">Led Zeppelin</MTVNLINK>'s 1970 Stonehenge of rock, "Whole Lotta Love." And that's before singer Robert Plant leans into one of the nastiest, ecstatic rock screams this side of the Who's "Won't Get Fooled Again." That's the song Adam Lambert chose to sing on <a href="/news/articles/1610708/adam-allison-shine-on-idol-rock-night.jhtml">"American Idol" rock night</a> Tuesday (May 5), and, needless to say, it was a challenge that the eyeliner-loving Los Angeles stage veteran was more than up for, hitting a series of high notes and rock screams that would have made Plant proud. It was a risky maneuver that paid off for Lambert, who chose a tune that came in at #75 on <I>Rolling Stone</i> magazine's list of the "500 Greatest Songs of All Time" in 2004. </p><div style="margin: 0px 10px 10px 0px; float: left;"> <embed src="http://media.mtvnservices.com/mgid:uma:video:mtvmusic.com:84215" width="256" height="223" type="application/x-shockwave-flash" flashVars="dist=http://www.mtvmusic.com" allowFullScreen="true" AllowScriptAccess="always"></embed></div><p> The legendary British rock act recorded the tribute to Chicago blues icon Willie Dixon during their second U.S. tour after working it out in their live show, including it on their 1969 classic album <I>Led Zeppelin II.</i> Like many of the songs Zeppelin performed early in their career, "Love" was a blues standard turned on its head with a heavy dose of crunching psychedelic guitar and thundering drums, courtesy of late drummer John Bonham. The song was based on a 1962 tune by another blues forefather, Muddy Waters, called "You Need Love," which was penned by Dixon. For Zeppelin's version, Plant customized the lyrics by adding some lyrical quotes from a few other songs Dixon wrote for Howlin' Wolf, "Back Door Man" and "Shake For Me," nailing the tricky vocal in a single take. It was also inspired by 1966's "You Need Loving" from the British rock group the Small Faces, for whom Zeppelin had great affection, but they also did not credit Dixon for his part in writing the original lyrics. The song became Zeppelin's first U.S. single and their only U.S. top 10 hit. Though their manager would not let them release singles in the U.K. because he thought it cannibalized album sales, the song was finally released as the band's only British single in 1997. Dixon sued Zeppelin over the song in 1985, claiming it borrowed too heavily from his "You Need Love," and Zeppelin reached an agreement with him, with Dixon using the money he received to set up a program that provided musical instruments for schools. A cornerstone of heavy rock, the tune -- which was the theme song for the long-running British countdown show "Top of the Pops" in the 1970s and '80s -- has been covered by dozens of artists over the years, from Tina Turner and Ben Harper to Prince, Slash, Leona Lewis, Train's Pat Monahan, the London Symphony Orchestra and Jane's Addiction. <b>Get your "Idol" fix on MTV News' <a href="/news/articles/1486475/mtv-news-american-idol.jhtml">"American Idol" page</a>, where you'll find all the latest news, interviews and opinions.</b></p>

Oscars 2012 Ratings Up From Last Year
Ratings for Sunday night's telecast up 4 percent over 2011's show.
By Gil Kaufman

Photo: Jason Merritt/Getty Images
Sometimes "meh" is all you need — especially when you're following up one of the most reviled Oscar hosting teams in recent memory.
That might explain why, despite a night devoid of any major surprises or blockbuster winners, ratings for the 2012 Oscars telecast were up slightly over last year.
According to ABC's preliminary ratings, the Billy Crystal-hosted awards show had a 25.5 rating and 37 share, a 4 percent increase over the 2011 show, which famously bombed thanks to the lack of chemistry between hosts James Franco and Anne Hathaway. Crystal's safe-as-milk ninth go-round as host earned the veteran comedian mostly tepid to negative reviews, but it was enough to boost the big night to one of its best ratings nights since 2007, when the show put up a 27.7 rating and 42 share.
The highest-ever Oscar ratings came in 1998, when the global blockbuster "Titanic" helped draw in more than 55 million viewers.
Ratings might have been even higher if any of the most-nominated movies had posted solid box-office figures as well. But between them, the leading winners, "The Artist" and "Hugo," which both reveled in a nostalgic look back at the dawn of the modern movie era, have grossed just over $100 million combined to date. To put that in perspective, popcorn flick "Transformers: Dark of the Moon," which was blanked in three technical categories, brought in nearly that much in its opening weekend.
More complete ratings numbers are expected later in the day on Monday (February 27).
The MTV Movies team has the 2012 Oscars covered! Keep it locked at MTV.com for updates on the night's big winners and the best red-carpet fashion.

Lil Wayne, Usher Help Romeo Santos 'Revolutionize' Bachata Music

<P><P><P><a href="http://www.mtv.com/music/artist/romeo_santos/artist.jhtml">Romeo Santos</a>, the former lead singer of the popular bachata group <a href="http://www.mtv.com/music/artist/aventura/artist.jhtml">Aventura</a>, has taken a new step in his career, venturing out on his own as a solo artist. Mixing his signature bachata flair with some R&B, he is showing fans a whole new side on his debut album, <i>Formula, Vol. 1.</i> </p><div class="player-placeholder right" id="vid:734074" width="240" height="211"></div><p> Hoping to spread his unique sound and style to a mainstream audience, Santos enlisted <a href="http://www.mtv.com/music/artist/lil_wayne/artist.jhtml">Lil Wayne</a> for his latest single, "All Aboard." "This song 'All Aboard,' that tune allowed me to expand and kind of offer my audience something totally different because it's not bachata — I'm singing English and that was really fun," Santos recently told MTV News. "I was a little nervous about that, but people actually really accepted it." Santos and Weezy recently shot the video for "All Aboard" in Miami; he called the clip "sexy," "seductive" and "elegant," but also revealed that this collaboration came very close to not making his album. "I was just like, I like the song but it's missing something, and at first I couldn't figure out what it was," Santos said. "What we did was we left 16 bars open, and I was like, you know, who would rip this track? Lil Wayne. So we reached out. It barely made the album because he's a busy dude, so he actually got on the record two months after we submitted it. It was like, if we don't get his vocals in the next two days we hit, and we got it, so we made it and the song is just really great." Wayne isn't the only artist Santos pulled in for his album. On his last single, "Promise," he teamed up with <a href="http://www.mtv.com/music/artist/usher/artist.jhtml">Usher</a>, who last week joined him onstage at <a href="/news/articles/1678993/romeo-santos-solo-tour.jhtml">Santos' first of three sold-out shows</a> at New York's Madison Square Garden. "I felt at that moment once again I was going to revolutionize bachata 'cause it was the first time that you hear an artist from the mainstream singing bachata," Santos said. "It was a big deal." <i>What do you think of Romeo Santos' solo debut? Let us know in the comments.</i></p></p></p>

Madonna Drops New Single 'Girl Gone Wild'

Madonna's "Girl Gone Wild"

Madonna kicked the party off with "Give Me All Your Luvin', " and she's keeping it going with her second MDNA single, "Girl Gone Wild." The thumping song, released Monday (February 27), proves that this era of Madonna will certainly be focused on pumping out dance-floor anthems.
"Girl Gone Wild" is all about the heat of letting loose and dancing, certainly themes that Madge fans will find familiar. Produced by Benny Benassi, the track, though fun and funky, is a bit darker than her first single, which seemed to pay homage to the '80s version of the pop icon in its bright nature.
"I got that burnin' hot desire/ And no one can put out my fire/ It's coming right down through the wire/ Here it comes/ When I hear them 808 drums/ It's got me singing," she proclaims on the catchy, sing-along chorus. "Hey, ey, ey, ey/ Like a girl gone wild/ A good girl gone wild/ I'm like, hey, ey, ey, ey/ Like a girl gone wild/ A good girl gone wild."
The song chugs along thanks to more dance-floor confessions from the singer, which include, "The room is spinning/ It must be the Tanqueray/ I'm about to go astray/ My inhibition's gone away/ I feel like sinning/ You got me in the zone/ DJ play my favorite song/ Turn me on."
The video was shot earlier this month and was directed by fashion photographers Mert and Marcus, who also shot the colorful artwork for the album. It had been rumored that Britney Spears would be featured on the track, but that rumor was shot down by Madonna herself.
MDNA will drop on March 26. It features production from collaborators like Martin Solveig and William Orbit, Demolition Crew, Alessandro "Alle" Benassi, Hardy "Indiigo" Muanza and Michael Malih.

Simon Cowell Squashes Beyonce, Mariah Carey 'X Factor' Rumors
Judge also takes shot at 'The Voice,' asking, 'How many artists have they discovered?'
By John Mitchell
<P>Simon Cowell is finally opening up about the cast shakeups on "The X Factor" as well as about rumors that two <i>very</i> famous divas are in talks to join Fox's reality singing competition. </p><div class="player-placeholder right" id="vid:698604.id:1672066" width="240" height="211"></div><p> Late last month, it was announced that judges Paula Abdul and Nicole Scherzinger and host Steve Jones had been <a href="/news/articles/1678191/paula-abdul-exits-x-factor.jhtml">fired from "X Factor"</a> and would be replaced in its second season. The announcement came as a shock to fans, but Cowell tells <a href="http://www.hollywoodreporter.com/live-feed/simon-cowell-x-factor-firings-voice-287806" target="_blank">"Extra"</a> in an interview airing Wednesday (February 8) that the decision was a long time coming and was ultimately made "at the beginning of the year — and we were told it had to happen straight away." While her dismissal came as a surprise, Cowell says Abdul "was very gracious" about it. "She understands it's business," Cowell said of his real-life friend. "It's never personal." Scherzinger, according to Cowell, was "disappointed" with the producers' decision to replace her. But the former Pussycat Doll insisted in a new <a href="http://www.accesshollywood.com/nicole-scherzinger-talks-x-factor-departure-i-have-no-regrets_article_60184" target="_blank">"Access Hollywood"</a> interview that she "had a wonderful experience on the show." "What happened? Well, all I know is that I gave 110 percent to that show," she said. "I know everybody's talking about it, they're saying good, bad, they love me or hate me, but the one thing you can't say is that I didn't give it my all." Cowell also used his time with "Extra" to squash rumors that Beyoncé or Mariah Carey might be joining the "X Factor" team when it returns to Fox later this year. He seemed particularly amused by <a href="http://www.reuters.com/article/2012/02/08/idUS114237084820120208" target="_blank">talk</a> that the show was offering Beyoncé a nine-figure contract to join the judges' table. "The budget for the show is $100 million. That would never ever happen. It's absolute nonsense," he told "Extra." "No one is going to pay $100 million for someone. I genuinely haven't had a conversation with her about it. Not at all." The same can be said for Carey, who Cowell said he likes very much and would be a fine addition to the show but is an impractical choice because of the long hours involved. "I adore her, love her," he said. "But you can't expect someone who has just had two kids [and] has a record career to make the kind of commitment we would need on this show." "X Factor" did not perform as strongly as expected in the ratings last fall, which many feel precipitated the planned revamp, though the ever-cool Cowell is not sweating the competition. In this latest interview, Cowell took on "The Voice," which returned to NBC after the Super Bowl and delivered big ratings, saying the makeup of his judging panel is what sets "X Factor" apart. "I would ask how many records have they made, how many artists have they discovered?" Cowell asked of "The Voice" mentors Christina Aguilera, Cee Lo Green, Adam Levine and Blake Shelton. "That's where we have to be different on the judging panel. It's very important that you have people on the panel that have actually signed and made artists successful all over the world, not just have made hit records yourself."</p>
